EU Data Act

The EU Data Act (Regulation 2023/2854) establishes new rules for data access, portability, and switching for cloud services. Sitenyx is fully committed to meeting all requirements.

What is the EU Data Act?

The EU Data Act, effective September 12, 2025, creates new rights for users of cloud and SaaS services. It ensures you can access, port, and switch your data freely, without lock-in or unreasonable barriers. The regulation applies to all SaaS providers serving EU customers, regardless of where the provider is based.

Data portability

You have the right to export all your data in standard, machine-readable formats. Sitenyx supports comprehensive data export:

  • Standard formats Export in CSV, JSON, XML, and SAF-T formats. Financial data exports follow the OECD SAF-T standard for maximum interoperability.
  • Export timeline Data exports are available within 30 days of request. Most exports complete within minutes for standard data volumes.
  • Full scope All user-generated data is exportable: financial records, invoices, customer data, website content, forms, files, and configuration.

Switching rights

You can terminate your Sitenyx subscription with a maximum of 60 days notice. During the transition period, you retain full access to your data and export capabilities. We provide documentation of our data formats, schemas, and APIs to facilitate migration to any other provider.

Interoperability

Sitenyx maintains open, documented APIs and supports standard data formats to ensure interoperability with other services. Our e-conomic integration uses the official REST API, and all financial data follows Danish and EU accounting standards.

No switching fees

As of January 12, 2027, switching fees are entirely eliminated under the EU Data Act. Sitenyx has already adopted this principle: we charge no switching fees, no data export fees, and no contract termination fees. Your data is yours.

Regulatory timeline

The EU Data Act entered into force on January 11, 2024, with provisions applying in phases. The data portability and switching requirements for cloud services took effect September 12, 2025. Product design requirements apply from September 12, 2026. Existing contract obligations apply from September 12, 2027.

Does the EU Data Act apply to Sitenyx?
Yes. The EU Data Act applies to all providers of data processing services (including SaaS) that serve customers in the EU. Sitenyx provides cloud-based services to EU customers and is therefore subject to the regulation.
How do I export my data?
You can export your data through the Admin dashboard under Settings, or by contacting support. We support multiple formats including CSV, JSON, and SAF-T. Most exports are available within minutes.
What are the penalties for non-compliance?
Penalties are set at the Member State level and must be effective, proportionate, and dissuasive. In some jurisdictions, fines can reach up to 3% of annual global turnover, with 5% for repeat offenses.
Does this apply to my existing contract?
Yes. The EU Data Act applies to both new and existing contracts. The switching and portability rights under Article 23-25 apply from September 12, 2025, and the existing contract provisions under Article 13 apply from September 12, 2027.
